Flashback: Progressive legal experts call Roe v. Wade constitutionally ‘indefensible’

The social media firestorm sparked by a leaked draft from the Supreme Courtroom suggesting an impending reversal of Roe v. Wade caused some on Twitter to place out that several outstanding progressives and constitutional authorities have openly questioned the validity of the controversial 1973 ruling.

In a Twitter thread posted by Grabien founder Tom Elliott, the journalist offers several illustrations of liberals criticizing the regulation which include previous Supreme Court Justice Ruth Bader Ginsburg who once identified as it a “”significant-handed judicial intervention [that] was tricky to justify and appears to have provoked, not solved, conflict.”

Lazarus also wrote that “as a subject of constitutional interpretation, even most liberal jurisprudes — if you administer truth serum — will inform you it is fundamentally indefensible.” 

John Hart Ely, a professor at  Yale Legislation Faculty, Harvard Regulation College, and Stanford Law School, wrote that Roe “is not constitutional law and offers practically no sense of an obligation to check out to be.”

Brookings Institute Senior Fellow  Benjamin Wittes referred to Roe as “a awful opinion that disenfranchised tens of millions of conservatives on an problem about which they treatment deeply” and progressive legal scholar Cass Sunstein has stated that “as a constitutional matter” he thinks “Roe was way overreached.”
