Former Texas cop charged for shooting teen eating hamburger outside McDonald’s – National

A now-former San Antonio law enforcement officer was billed Tuesday with two counts of aggravated assault by a peace officer for capturing and gravely wounding a teen who was eating a hamburger in his car or truck in a McDonald’s parking ton.

James Brennand, 25, was charged in the Oct. 2 shooting of Erik Cantu, 17, according to a police statement. He turned himself in to law enforcement Tuesday evening and remained in custody, said Law enforcement Main William McManus.

Cantu is unconscious and on lifetime assist, his loved ones stated Tuesday.

“There is no improvement in his affliction,” the relatives stated in a assertion sent by their law firm, Brian Powers. “The last two days have been difficult, and we anticipate additional problem in advance, but we stay hopeful.”

Powers reported it’s “an unbelievably tricky time for them.”

A rookie officer, Brennand claimed that the car in which Cantu was sitting down experienced evaded him the night in advance of through an attempted targeted visitors prevent. Brennand explained he suspected the vehicle was stolen.

In human body digital camera footage produced by law enforcement, Brennand opens the car door and tells Cantu to get out. The automobile drives backward, doorway open, and the officer fires various periods into the automobile. He proceeds to shoot as the vehicle drives absent.

Investigators swiftly determined that the use of lethal force was unwarranted, and Brennand was fired. Costs from Cantu of aggravated assault and evading arrest had been dropped.

Brennand is charged with two counts of assault because there was a passenger in the car. The passenger was unharmed.

In a press conference Tuesday evening, the law enforcement chief defended the department’s education and stated the failures were those of the person officer.

In an appearance on CNN earlier Tuesday, McManus reported he expected aggravated assault prices would be filed, and murder rates in the event Cantu dies.

McManus mentioned Brennand’s entire body camera video clip of the Oct. 2 taking pictures was “horrific.”

“There is no problem in anybody’s brain searching at that online video that the capturing is not justified,” McManus said.

Police officers and the Bexar County District Attorney’s Business office did not instantly return messages from The Affiliated Push. Brennand has no revealed telephone range and could not be attained for comment.

Cantu’s affliction, as similar in his family’s assertion, is in stark distinction to what police officials reported in the wake of the shooting: that Cantu was hospitalized in steady condition.

“We’d like to suitable any misrepresentations that Erik is in `stable condition’ or he is `going to be fine.’ That is not legitimate. Each individual breath is a struggle for Erik. We ask for everyone’s ongoing prayers for our son,” the loved ones claimed.
