BY a vote of 5 to 3, the Senate on Thursday adopted the impeachment regulations proposed by the Committee on Judiciary, Federal government, Legislation and Federal Relations and the Committee on Executive Appointments and Governmental Laws.

The regulations were adopted as Senate Resolution 22-1, which was introduced by Senate President Jude U. Hofschneider, a Republican from Tinian.

Ground amendments were being proposed by minority bloc Sens. Edith Deleon Guerrero, a Saipan Democrat, and Paul Manglona, a Rota impartial, and place to a vote, but these had been rejected, 3 to 5.

Signing up for Deleon Guerrero and Manglona in voting for the amendments was Rota Impartial Sen. Teresita Santos.

Senate Vice President Justo Quitugua, a Saipan Republican, was absent.

The other senators are Republicans Francisco Cruz of Tinan, Victor Hocog of Rota, Karl King-Nabors of Tinian, and Vinnie Sablan of Saipan, the operating mate of Republican Gov. Ralph DLG Torres.

Special session

Senate President Hofschneider pointed out during the session that special counsel Joe McDoulett was retained by his workplace to support with the impeachment guidelines.

For the general public comment period of the session, Hofschneider mentioned that 5 minutes would be allotted for each person for community reviews.

Democrat Rep. Leila Staffler was the first to choose the podium, questioning McDoulett’s function as “special counsel,” and opposing the proposed Senate impeachment policies.

“When I looked at the guidelines, I will not lie, I was stunned at the lengthy procedure, that at any supplied place prior to the real Senate impeachment trial proceedings could disqualify the copious amounts of proof that clearly show clear and repetitive actions of felony, corruption, and neglect of obligation by Governor Torres in excess of these a number of several years. Soon after the general public comment interval, the senators talked about the proposed impeachment regulations.

Senator Santos reported for the impeachment trial of previous Gov. Benigno Fitial in 2013, the senators “understood that their constitutional mandate was to carry out a good and impartial hearing, and not to obstacle the sufficiency or dismiss the Property articles of impeachment.”

Fitial resigned prior to the Senate could perform a trial.

Santos questioned the Senate impeachment guidelines for the demo of Torres.

“Mr. President, I do not understand why the committee chooses to dictate who must provide as the impeachment prosecutor,” she stated.

Santos pointed out that in the U.S. Congress, the impeachment administrators are chosen by the House speaker.

As for the rule to restrict the impeachment prosecutor to just the Household legal counsel and team, Santos said this is “unjust, unethical, unfair, and unreasonable” to the House of Reps.

“If these overreaching steps were being reciprocated, I undeniably question that the Senate would consent and tolerate these types of disregard [for] the separation of the houses of Legislature, and this has been echoed by several members of the Home of Representatives,” she additional.

She also pointed out that there had been no restrictions placed on who the impeached formal can have as lawful counsel and staff for the impeachment proceedings.

“Again, this is highly biased, partial, and unfair to the Property of Representatives… I am not a legal professional, but based on my comprehension of the proposed policies, the Senate will not be conducting a fair and neutral demo and, if these rules are adopted, we may not even have a trial at all. The proposed guidelines are littered with bias. It’s incredibly obvious and evident that the scales of justice have been deliberately tipped to accommodate the impeached,” she said.

According to Sen. Deleon Guerrero, “It is apparent that the adopted impeachment regulations do not spell justice.”

Senator Manglona also opposed the impeachment procedures.

Voting in favor of adopting the principles were being the Senate president, the Senate floor leader, Hocog, Cruz and King-Nabors.

All those opposed were Deleon Guerrero, Manglona and Santos.

On Jan. 12, 2022, by a vote of 15 to 4 with 1 abstention, the Democrat-Independent-led Home impeached the Republican governor for commission of felonies, corruption, and neglect of responsibility. He has denied the allegations.

He will be removed from business office if 6 members of the Republican-led Senate vote for his conviction.
